Fitness & health disclaimer

TrainNow is a marketplace that connects clients with independent, third-party fitness trainers. TrainNow does not itself provide personal training, medical, or health advice, and trainers found through the Platform are independent professionals, not employees or agents of TrainNow.

Always consult a qualified physician before beginning any new exercise program, particularly if you have an existing medical condition, injury, or are pregnant.
Physical exercise carries an inherent risk of injury. You participate in any session booked through TrainNow at your own risk.
TrainNow verifies identity and reviews submitted certifications for trainers on the Platform, but does not guarantee the ongoing conduct, technique, or advice of any individual trainer.
If you experience a medical emergency during a session, contact local emergency services immediately.

Intellectual property

The TrainNow name, logo, app, and website — including their design, text, graphics, and underlying code — are the property of TrainNow, Inc. or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.
Content you post on the Platform (such as reviews or messages) remains yours, but you grant TrainNow a license to use it to operate and promote the Platform, as described in our Terms of Use.
Trainers retain ownership of their own original training programs and materials, subject to the license granted to TrainNow for the purpose of operating the Platform.

Limitation of liability

To the maximum extent permitted by law, TrainNow, Inc. and its officers, employees, and affiliates are not liable for indirect, incidental, special, or consequential damages arising from your use of the Platform, including injuries sustained during a session booked through TrainNow, actions of independent trainers, or service interruptions.

Nothing in this notice limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, willful misconduct, or death or personal injury caused by our own proven negligence.

Governing law

This notice and your use of the Platform are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where local consumer protection law requires otherwise for users located outside the United States.

Dispute resolution

We encourage you to contact us first at support@trainnowafrica.app to resolve any issue informally. Formal dispute resolution procedures, including any arbitration agreement and class action waiver applicable to your account, are set out in full in our Terms of Use.
